Terms of service

This page is provided in English only. The English version of these Terms is the one that legally applies.

These Terms of Service govern your use of Zaily. By starting a plan or a trial, or by otherwise ordering from us, you agree to them.

1 — Who we are

  • Zaily (“we”, “us”) is a short-form video production and publishing service for Minecraft servers, operated by a sole trader established in France.
  • You (“the customer”) are the person or organisation holding the Zaily account and paying for the service. You confirm you are authorised to represent the server the service is ordered for.

  • Payments are processed by Stripe Payments Europe, Ltd. and its affiliates. We never see or store your full card number.

2 — Plans, trials and what you get

  • A plan is a monthly subscription: we produce videos at the plan's daily cadence and publish them on channels we create and run for your server across TikTok, YouTube Shorts, Instagram Reels and Snapchat Spotlight. The cadence, monthly video count and number of channels are those shown for your plan at checkout.
  • A trial is a one-off order of a fixed number of videos. We deliver the finished files to your dashboard; you publish them yourself. A trial includes no channels and no publishing by us.
  • Every order includes script writing, a synthetic voiceover, captions, editing, clips recorded on your server, and an end card carrying your details. There are no paid add-ons.
  • Production uses an AI-assisted pipeline and a synthetic voiceover. This is disclosed here and on our site; it is not a defect.

3 — Billing

  • Currency. All prices are in US dollars. Any applicable taxes are included in the price shown; we do not add tax at checkout. If your bank converts the charge to another currency, any conversion fee is set by your bank, not by us.
  • Plans — when you are charged. At checkout your card is securely saved and nothing is charged that day. The first charge is taken on the day your first videos for that plan are published. From then on, the plan renews and is charged every month on that date, for as long as it is active.
  • Authorisation. By saving your card you authorise us, through Stripe, to charge it the plan amount each month without further action from you, until you cancel. Stripe may ask your bank to verify the card when you save it; this verification is what lets later monthly charges go through.
  • Trials. A trial is charged in full at checkout. If you later move to a plan, the trial amount is credited against your first month.
  • Promo codes. A discount applies as stated by the code (for example, first month only, or a set number of months). Codes cannot be combined or applied after checkout.
  • Invoices and receipts. A receipt is issued for every payment and is available from your dashboard and by email. You can view and download your full billing history at any time from the billing portal linked in your dashboard.
  • Failed payments. If a monthly charge is declined, Stripe retries the card over the following days. Videos already in production are still delivered; the next month's batch does not begin until payment clears. If it has not cleared after Stripe's retry period, the plan may be suspended or cancelled.
  • Price changes. We may change plan prices. A plan that is already active keeps the price you signed up at; a new price applies only if you start a new plan or change plan. We give at least 30 days' notice by email before any change that would affect an active plan.

4 — Cancellation and refunds

  • You can cancel a plan at any time from your dashboard billing portal. Cancellation stops the next renewal.
  • The month you have already paid for is not refunded: production and publishing for that month run to completion, and you keep everything delivered.
  • We do not give partial or pro-rated refunds for a cancelled month, and trials are non-refundable.
  • If we cannot deliver a paid month's videos for reasons attributable to us, we will either complete delivery or refund the unfulfilled portion of that month — that is the full extent of our refund obligation.
  • We may suspend or end the service for non-payment, abuse, illegal use, or a serious breach of these Terms.

5 — Delivery

  • Your first video is delivered within 72 hours of your server details being submitted. After that, videos are produced and delivered in batches rather than all at once, because a steady posting history performs better than a burst.
  • On a plan, we publish on the channels we run for you at the plan's cadence, and you follow progress and results from your dashboard.
  • If a video badly underperforms the rest of its batch, we recut and repost it at our cost. We do not guarantee any particular view count.

6 — Channels and content rights

  • Channels. Channels we open for your server are yours. You receive the credentials, and if you stop working with us you keep the channels and everything on them.
  • Copyright in the finished videos belongs to you. We keep a non-exclusive right to use them to show our own work (portfolio, examples, advertising).
  • You may not resell, sublicense or redistribute the videos as a standalone product.
  • You are responsible for the material you give us (server access, logo, text) and confirm you have the right to use it. You must not ask us to produce content that is illegal, infringing, or that misrepresents your server.

7 — Disclaimer and limitation of liability

  • Our role is limited to producing and publishing promotional video content.
  • We do not guarantee outcomes such as server growth, player numbers, retention or revenue.
  • To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, including lost profit, lost players or reputational harm. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim.
  • Nothing in these Terms excludes liability that cannot be excluded under French law.

8 — Changes to these Terms

We may update these Terms. If a change materially affects an active plan, we give notice by email at least 30 days before it takes effect; continuing to use the service after that date means you accept the updated Terms. The date at the top of this page shows the current version.

9 — Governing law and disputes

  • These Terms are governed by the laws of France.
  • Both parties will attempt an amicable resolution first. Failing that, the courts of the operator's place of establishment in France have jurisdiction, subject to any consumer-protection rules that give you the right to bring proceedings elsewhere.

10 — Acceptance

By starting a plan or a trial, you confirm you have read, understood and accepted these Terms of Service.
